Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the FIT Africa coaching platform (“Platform”) operated by FIT Africa Technologies Ltd (“FIT Africa”, “we”, “our”, or “us”). By creating an account or accessing the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. Definitions

  • "Platform" means the FIT Africa web application, client portal, coach portal, enterprise portal, and associated APIs accessible at fitafrica.tech and related domains.
  • "Coach" means a personal trainer, sports coach, or fitness professional who creates a coach account to manage clients and deliver coaching services.
  • "Client" means an individual who accesses the Platform through a coach invitation to receive coaching services.
  • "Enterprise" means an organisation that subscribes to the enterprise tier to manage multiple coaches and a client population.
  • "Account" means your registered account on the Platform, including all associated data and settings.
  • "Content" means any information, programmes, workouts, media, or materials uploaded or created on the Platform.

2. Eligibility and Account Registration

You must be at least 18 years old to create a Coach or Enterprise account. Clients must be at least 16 years old, or have parental or guardian consent if younger where applicable by local law.

When registering, you agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and update your account information to keep it accurate.
  • Keep your login credentials confidential and not share them with others.
  • Notify us immediately if you suspect unauthorised access to your account.
  • Be responsible for all activity that occurs under your account.

We reserve the right to refuse registration or suspend accounts at our discretion where we have reason to believe these Terms are being violated.

3. Coach Responsibilities

Coaches who use the Platform to provide coaching services to clients are solely responsible for:

  • The quality, accuracy, and safety of the fitness programmes and advice they deliver to clients.
  • Ensuring they hold any required qualifications, certifications, or licences to practise as a fitness professional in their jurisdiction.
  • Obtaining appropriate consent from clients before collecting or recording health-related information.
  • Maintaining the confidentiality and professional handling of their clients' personal information.
  • Communicating professionally and appropriately with clients through the Platform.
  • Accurately representing their services, qualifications, and pricing to clients.
  • Setting and communicating reasonable service terms to their own clients where applicable.

FIT Africa provides technology tools. The coaching relationship and professional obligations remain between the coach and their client. FIT Africa is not a party to that relationship and does not supervise or guarantee the quality of coaching delivered through the Platform.

4. Client Responsibilities

Clients who access the Platform agree to:

  • Consult a qualified medical professional before beginning any new exercise programme, particularly if you have a pre-existing health condition, injury, or medical concern.
  • Provide accurate health information to your coach to enable appropriate programme design.
  • Use the Platform and its fitness content at your own risk and in accordance with your physical capabilities.
  • Communicate openly with your coach about any discomfort, injury, or health changes during your programme.
  • Not use the Platform as a substitute for medical diagnosis, treatment, or professional health advice.

5. Acceptable Use

You agree not to use the Platform to:

  • Violate any applicable law or regulation.
  • Upload, distribute, or transmit content that is unlawful, harmful, abusive, defamatory, or offensive.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.
  • Attempt to gain unauthorised access to other accounts, systems, or networks connected to the Platform.
  • Use automated tools, bots, or scripts to access or scrape the Platform without authorisation.
  • Introduce malware, viruses, or any code intended to disrupt or damage the Platform or its users.
  • Use another user's data for purposes outside the coaching relationship.
  • Engage in conduct that harasses, intimidates, or discriminates against any user.

6. Platform Availability

We aim to maintain reliable access to the Platform but do not guarantee uninterrupted availability. The Platform may be temporarily unavailable due to:

  • Planned maintenance windows (where possible, announced in advance).
  • Unplanned technical incidents or infrastructure outages.
  • External service disruptions beyond our reasonable control.

We are not liable for losses arising from Platform unavailability, except where required by applicable law.

7. Subscriptions and Payments

Certain Platform features require a paid subscription. Where subscriptions apply:

  • Subscription fees are billed in advance on the frequency stated at checkout (monthly or annual).
  • Subscriptions renew automatically unless cancelled before the renewal date.
  • You can cancel your subscription at any time through your account settings or by contacting support.
  • Refunds are handled at our discretion and in accordance with applicable consumer protection laws.
  • We reserve the right to change pricing with reasonable advance notice. Continued use after a price change constitutes acceptance.
  • Payments are processed by third-party payment processors. FIT Africa does not store your payment card details.

8. Intellectual Property

Platform IP: The FIT Africa Platform, including its design, software, trademarks, and branded content, is owned by FIT Africa Technologies Ltd. You are granted a limited, non-exclusive, non-transferable licence to use the Platform for its intended purpose while your account is active.

Your Content: You retain ownership of content you upload to the Platform, including workout programmes, client data, and media files. By uploading content, you grant FIT Africa a limited licence to store, process, and display that content for the purpose of delivering Platform services.

Restrictions: You may not reproduce, copy, sell, or distribute any part of the Platform without our written permission. You may not reverse-engineer or attempt to extract the source code of the Platform.

9. Health and Fitness Disclaimer

The Platform provides tools for coaching professionals to deliver fitness programmes to their clients. FIT Africa is a technology provider, not a healthcare provider.

  • Content delivered through the Platform is for fitness and wellness purposes only and does not constitute medical advice.
  • FIT Africa does not review, verify, or endorse the fitness programmes created by coaches on the Platform.
  • Users participate in fitness activities at their own risk. FIT Africa is not responsible for injuries or health outcomes.
  • If you experience pain, discomfort, or a health event, stop activity immediately and consult a medical professional.

10. Account Suspension and Termination

We may suspend or terminate your account without prior notice if:

  • You breach these Terms or our Acceptable Use policy.
  • We receive credible reports of conduct harmful to other users.
  • Your account is used fraudulently or in a manner that damages the Platform or its users.
  • Payment obligations are not met and remain unresolved after a reasonable period.

You may delete your account at any time. See our Data Deletion page for details. Termination of your account does not affect accrued rights or obligations prior to termination.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

  • FIT Africa provides the Platform on an "as is" and "as available" basis without warranties of any kind, express or implied.
  • We are not liable for indirect, incidental, special, or consequential damages arising from your use of the Platform.
  • Our total liability to you in connection with the Platform shall not exceed the amount you paid to us in the 12 months preceding the claim, or £100, whichever is greater.
  • Nothing in these Terms limits liability for fraud, death, or personal injury caused by our negligence, where such limitation is prohibited by law.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which FIT Africa Technologies Ltd is incorporated, without regard to conflict of laws principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the effective date and notify users via email or in-app notice where appropriate. Continued use of the Platform after updated Terms are published constitutes acceptance of the revised Terms. If you do not agree with updated Terms, you should stop using the Platform and delete your account.
